Non solo ripercorrendo la genesi \"popolare\" della Repubblica italiana e della sua Costituzione ma anche, in una prospettiva di storia costituzionale, quella dello Statuto Albertino del 1848, carta octroyée di origine \"monarchica\" divenuta nel 1861 la prima Costituzione dell'Italia unita sotto la monarchia sabauda.

The paper is dedicated to a distinguished Italian professor of international law, Tomaso Perassi (1886-1960), who graduated from Pavia University in 1909 with some studies in public law and became one of the most important founding fathers at the Constituent Assembly during the foundation of the Italian Republic (1946-1947). More relevance is given to the elements striktly linked to the genesis of his political opinions (ever since his youth, he had been a member of the Italian republican party) and his first public law studies in connection with his later contribution to the Italian Constitution.

A discussion among Italian jurists on the nature of national unification

The current paper deals with the debate over the interpretation of the Italian union as it was illustrated by professor Paolo Biscaretti di Ruffia in 1961, on the occasion of the 100th anniversary of the unification of Italy. In particular, his article may be considered a significant compendium of the different positions within the Italian legal scholarship about the unification process. Subsequently, with a few rare exceptions (Costantino Mortati), this subject has been of little interest to the same scholarship leaving a question in a state of uncertainty: foundation of a new State or continuity with the Piedmont Kingdom, although the second thesis prevails.

In this introduction, the author offers a brief overview of the constant interest shown by the journal \"Il Politico\" on the subject of constitutional law and, in particular, the developments of the 1948 Charter. She then focuses on the historical context out of which the various \"internationally-oriented precepts\" of the 1948 Constitution were born. These references appear to acquire new meaning, if we take into account Italy's adhesion to the three European Communities, more recently merged together in the Union.
